Terms And Conditions

OUR COMMITMENT
Our hope is that your first trip with Komodo Kayaking is just one of many. Thus our goal is to provide thorough and complete communications and be clear with the details of our agreement with you.  Because the fine print sometimes changes, you will receive the most current Terms & Conditions along with your travel documents at the time of booking.

By using this website and the PT Komodo Kayaking Indonesia (DBA Komodo Kayaking…henceforth referred to as “Komodo Kayaking”) online booking service (by website, E-mail, or WhatsApp), you are agreeing to be bound by the Terms and Conditions detailed below, which form the basis of your contract with Komodo Kayaking operating under the name Komodo Kayaking. In the Terms and Conditions set out below, “you”, “your”, and “the guest” refer to all persons named on the booking, which includes any individual(s) subsequently added or substituted at a later date. “We”, “us”, “our”, and “the owner” all refer to Komodo Kayaking. These Terms, and any rights and licenses granted hereunder, may not be transferred or assigned by you without the prior written consent of kimkim. No waiver of any provision of these Terms will constitute a waiver of such provision in any prior, concurrent or subsequent circumstance, and Komodo Kayaking’s failure to assert any right or provision under these Terms will not constitute a waiver of such right or provision. Except as otherwise provided herein, these Terms are intended solely for the benefit of the parties and are not intended to confer third party beneficiary rights upon any other person or entity.

 

This Contract is governed by the laws and regulations of the Republic of Indonesia. Any disputes, challenges or resolutions related to this contract will be undertaken following the Laws and Regulations of the Republic of Indonesia.

PRIVACY POLICY
Our terms and conditions include this privacy policy with regard to sharing customer information, data collection, marketing, email newsletters, and cookies.

Rates/Currency

All rates are priced in Indonesian Rupiah (IDR). For ease of communication and usage – our website, booking system and communications may substitute US Dollars (USD $) based on current exchange rates.  All prices and rates are inclusive of tax or service charges (unless otherwise stated).

Rates do not include gratuities, cars and drivers, or any other service, unless stated otherwise.

Payments can only be made by bank transfer or Wise (Wise Accounts). Payments made by bank transfer will be converted to IDR  at the rate applicable at the date of payment. Some conditions apply, and full details will be given at the time of booking.

For bank transfers, any additional transfer charges will be added to the total amount, all paid by the Guests or their Agents.

It is not possible to pay in person or upon arrival. If Komodo Kayaking has received a deposit, but the balance has not been paid 24 hours before arrival – your stay is NOT confirmed, you will not be accommodated, and no refund is possible.

Payment by Traveler’s Cheques or personal cheques will not be accepted.

Final payment is required a minimum of 24 hours before arrival (IDR, US$) via bank transfer, or Wise (Wise accounts). If the balance payment is not received by the due date, the owner reserves the right to cancel the booking and retain the deposit.

In the case of bookings made 15 days or less prior to arrival, full payment is required.

PREPARING FOR YOUR TRIP


We do our best to provide you with all kinds of great resources to prepare for your trip.  These include packing lists, reading lists, detailed itineraries, and more.  All of our multi-day trips include all necessary supplies. The reservation email we send you includes a detailed gear list of what you should bring.   

Most of our trips are suitable for beginners; however, some are more active than others.  A spirit of flexibility and adventure is a good thing to bring along.   It’s important that you understand the physical requirements for whatever trip you choose.  If you’re not sure about this, or you’re not sure which trip or date will best meet your needs, please call for advice from our talented and knowledgeable Adventure Consultants.  Be sure to read the “Trip Member’s Responsibility” below and if you have any medical concerns we encourage you to speak with your doctor before reserving space on a trip.

If you are planning a special event during the trip such as a birthday or anniversary, please let us know as always have a few surprises up our sleeves.  On our trip application form, you can indicate any food need you might have and we’re happy to accommodate those.

DEPOSITS
All trips require a deposit per person and to confirm your space(s) within 10 days of your reservation.

BALANCE DUE
Full payment is due 60 or 90 days prior to departure (trip dependant).

Reservations made after the balance due date must be paid in full at the time of booking. We reserve the right to cancel your reservation if full payment is not received by the due date.  

CANCELLATIONS AND REFUNDS
If you find it necessary to cancel your trip, you should notify Komodo Kayaking in writing, by e-mail immediately.  If written cancellation is received (call to verify) before the final balance is due, you will be given a refund less the amount of the deposit.  Deposits are not refundable.  If cancellations are made on or after the final due date, no money will be refunded.  If you are unable to go on the trip, you are welcome to find a replacement for yourself.  Please understand that once you’ve signed up, we lose the right to sell your reserved space to other individuals or groups.  Therefore, we regret that we cannot make exceptions for personal emergencies.  

Cancellation of a booking includes but is not limited to:

  • Cancellation of one or more nights or a booking;
  • Cancellation of one or more activities or services;
  • An amendment to a booking so that none of the dates of the booking once amended fall within the same dates that originally constituted the booking;
  • Refusal of the guest to sign the waiver of liability. 

 

CHANGES TO BOOKINGS

If you wish to change your booking in any way, you must contact us as soon as possible, and we will attempt to accommodate your request to the best of our ability and availability. Surcharges may apply. Changes occurring less than 7 days before departure are treated as cancellations. 

GROUP AND CHARTER RATES
On some trips, we offer a Group Rate for groups of 10 or more.  We are also happy to arrange private charter trips. Contact us for details.

Equipment:
Komodo Kayaking provides all the necessary technical equipment for their activities. The equipment is in excellent condition and suitable for the purpose. You only need to bring the specific items mentioned on our ‘What to Bring’ page and should be included in your booking confirmation email.

The use of equipment should be limited to the activity as instructed by your guide. Any damage caused to their equipment due to improper use will result in charges for replacement or repair. Any loss of equipment will result in charges for replacement

TRAVEL PROTECTION PLAN
We strongly recommend that you purchase a travel protection plan which can include a full trip refund should you cancel at any time for medical or health reasons. Coverage also includes medical evacuation, trip delay, and other elements.  

TRIP MEMBER’S RESPONSIBILITY
Trip members have the responsibility to select a trip appropriate to their abilities and interests. We are happy to discuss the trip with you if you have any questions or concerns. Trip members are held responsible for being in sufficiently good health to undertake the trip. Members are also responsible for studying all pre-departure information; for bringing the appropriate clothing and equipment as detailed therein and, for acting in a manner considerate of fellow group members.

Any person who is diabetic, epileptic, or asthmatic or has a history of heart trouble, is allergic to bee/scorpion stings, or takes daily prescription drugs should include this information on the reservation form or inform our office. Trip members will also alert their guide (s) of any medical history that could become a problem on the trip. People with a history of heart trouble, pregnant women, or any other potentially serious medical condition should consult their doctor before coming on a trip.

RESPONSIBILITY ~ AN IMPORTANT NOTICE
Payment of your deposit represents your acceptance of the following conditions: PT Komodo Kayaking Indonesia (DBA as Komodo Kayaking), its subsidiaries, and cooperating agencies act only in the capacity of agents for the participants in all matters relating to transportation and/or all other related travel services and assume no responsibility or liability whatsoever for injury, loss or damage to person or property, however, caused, in connection with any service, including, but not limited to, that resulting directly or indirectly from acts of God, detention, irregularity, annoyance, delays, and expenses arising from strikes, theft, quarantine, pilferage, force majeure, failure of any means of conveyance to arrive or depart as scheduled, government restrictions or regulations, civil disturbances, and discrepancies or changes in transit over which we have no control.

Komodo Kayaking reserves the right, either prior to or after departure, in its good-faith discretion and in circumstances that warrant it, to change or re-price any tour, trip, or expedition.  This includes the possibility of moving to a different itinerary due to extreme weather conditions, airport closures, and/or acts of God. 
If we are not able to provide a substitute itinerary and have to cancel the departure completely, you will be refunded in full. Refunds are limited to the amount actually paid to Komodo Kayaking.

Komodo Kayaking must normally make substantial payments to its suppliers (hotels, transportation companies, etc.) far in advance of the trip departure date.  If Komodo Kayaking cancels any tour, trip, or expedition due to acts of insurrection, force majeure, strikes, popular demonstrations, acts of God, earthquake, flooding, or any cause beyond its control, Komodo Kayaking will refund the portion of the trip cost not already advanced to suppliers and use its best efforts to recover and refund the balance as promptly as possible.

Komodo Kayaking reserves the right to cancel trips that are below the trip minimum (usually 4-5 persons).  All trip members will be notified a minimum of 30 days before the trip departs and will receive a full refund.

In the event of trip cancellation, Komodo Kayaking is not responsible for additional expenses incurred by trip members, such as penalties incurred through the purchase of non-refundable airline tickets, medical expenses, and passport and visa fees.

 

SURCHARGES

Komodo Kayaking reserves the right to change the booking costs to take account of the following items:

Fluctuations in currency exchange rates which adversely affect our costs,

An increase in Government taxes/fees on our goods or services we provide, including an increase in the cost of fuel, sudden changes to National Park fees, Park Ranger fees, Harbor fees

PT KKI will not absorb any increase in booking price should a surcharge be necessary

 

AIR RESERVATIONS
Once you have booked your flights, please fax or mail us a copy of your air itinerary so we can inform your trip leader of your expected arrival. Flight delays and cancellations do happen and can affect your ability to join a trip. We have set departure times and can not delay departures for individual guests. This may result in your species being cancelled with no refund. It may be possible to book individual boat hires to bring you to our boat during a scheduled trip – but that would be done at your own expense.For this reason we strongly advise having travel insurance that covers such situations. 

 

Sea Kayaking Expedition Terms:


Sea kayaking on expeditions can be a physically and mentally demanding activity. The customer assumes full responsibility for selecting the appropriate expedition based on their ability. Please assess your current skill level, fitness, and ability realistically. If you are unsure of your ability, please contact us.

Medical: All clients must complete a medical information form before starting an expedition. It is your responsibility to disclose any medical information that may affect your participation or the safety of other members of the group during the expedition.

Our expedition leaders are highly skilled and experienced and will provide instruction and coaching to ensure the successful completion of your expedition. However, they do not offer full journey towing services, so you must take primary responsibility for your progress.

Familiarization/assessment: Komodo Kayaking reserves the right to prevent a guest from participating in the expedition if they believe the customer lacks the necessary skills, physical/mental ability, or fitness without significantly impacting their staff or other guests. In some cases the same conditions apply to single days of an expedition and no refund or credit will be given for that day. 

Endurance: Kayaking expedition days typically involve traveling 20-30km per day. To reach the destination in a reasonable time, it requires traveling between 4 and 6 km per hour, regardless of sea state or weather conditions. On some longer expeditions this can constitute open water crossings. 

Weather: If the guide deems the conditions unsuitable to continue, Komodo Kayaking reserves the right to cancel, curtail, or change the route and itinerary based on the conditions and the group’s ability. However, every opportunity will be taken to make the most of the sea conditions while ensuring safety.

Expedition Sickness: If a customer experiences a debilitating illness during the expedition (excluding alcohol or drug-related issues) that prevents them from continuing, Komodo Kayaking will facilitate and cover the evacuation expenses to nearest suitable medical care. From the time onwards the customer is responsible for all medical and travel fees. All clients must have their own medical and travel insurance that covers sea kayaking in remote areas. Only the customer who falls ill will be assisted with transport back to Labuan Bajo. Any illness or injury directly attributable to Komodo Kayaking will be covered by their own insurance.

Please note that some locations on our expeditions are remote and may have limited access to immediate medical assistance, communication or travel links. We follow a detailed Emergency Plan and will follow procedures as laid out in that plan. 

WAITING LISTS
If you wish to be wait-listed for a full trip, a normal deposit is required.  If an opening occurs on the trip, you will be informed and automatically transferred to the trip roster if you wish to join the trip, subject to the normal cancellation policy should you accept the slot.   Otherwise, your deposit will be refunded in full.

Komodo Kayaking reserves the right to take photographic or film records of any of our trips and may use any such records for promotional and/or commercial purposes.

Komodo Kayaking reserves the right to decline, to accept – or restrain from further participation – any person whose actions or deportment impede trip operations or rights, welfare, or enjoyment of other trip members. All laws and regulations of Indonesia must be followed at all times – failure to do so puts crew, staff and other individuals at risk.  A refund based on the cost of unused services is the limit of Komodo Kayaking’ responsibility.

Termination

Komodo Kayaking  reserves the right, without notice and in its sole discretion, to terminate your license to access and use our Services and to block or prevent future your future access to and use of our Services.
